Terms and Conditions

1. Introduction and Acceptance

Welcome to MyBader, a community-based social media platform owned and operated by MAIG Private Limited, a company incorporated under the Companies Act, 2013, having its registered office at No. 18, Thimmakka Layout, C.N.Halli, R T Nagar, Bangalore North, Karnataka, India, 560032. These Terms and Conditions ("Terms") govern your access to and use of the MyBader application, website, and services (collectively, the "Service").

MyBader is designed specifically for members of certain communities and requires approval to access all features. By accessing or using MyBader, you agree to be bound by these Terms and all applicable laws and regulations of India, including but not limited to the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. If you do not agree with any of these terms, you are prohibited from using or accessing this service.

These Terms constitute a legally binding agreement between you and MAIG Private Limited. Users of any age may register for the Service with appropriate parental or guardian consent for minors. However, full access to all features requires administrative approval.

Important: You must check "I agree to the Terms of Use and Community Guidelines" before using the app.

2. No Tolerance Policy for Objectionable Content

We prohibit harmful or abusive behavior on our platform. The following types of content and behavior are strictly prohibited:

  • Objectionable, obscene, or offensive content
  • Harassment, stalking, or abuse
  • Hate speech targeting religion, caste, gender, nationality, or ethnicity
  • Threats of violence or self-harm
  • Illegal or explicit material

Any content that violates these guidelines will be removed, and repeated violations may result in account suspension or termination.

3. Definitions

For the purpose of these Terms:

  • "Content" means any information, text, graphics, photos, videos, audio files, links, or materials uploaded, downloaded, or appearing on the Service.
  • "User" means an individual who has created an account on MyBader.
  • "User Content" means all Content that a User posts, uploads, publishes, submits, transmits, or includes in their profile or shares on the Service.
  • "MyBader Content" means all Content that is owned by or licensed to MAIG Private Limited and made available through the Service.
  • "Intellectual Property Rights" means all patent rights, copyright rights, mask work rights, moral rights, rights of publicity, trademark, trade dress and service mark rights, goodwill, trade secret rights and other intellectual property rights that may exist now or come into existence in the future.

4. Account Registration and Security

To use the Service, you must register for an account. During registration, we collect the following information:

  • Username: To identify you on the platform
  • Mobile Number: For authentication purposes, account recovery, and security verification via OTP
  • Email Address: For communications and account recovery
  • Preferred Temple: To associate you with your community
  • Password: For account security

4.1 Mobile Number Usage & Privacy

Your mobile number is required for OTP-based authentication and verification. It is:

  • Securely stored with encryption
  • Not visible to other users unless you choose to share it
  • Never shared with external third parties
  • Used only for account verification, security, and critical notifications

4.2 Why We Collect Your Mobile Number

We require your mobile number for the following specific purposes:

  • Authentication: Your mobile number serves as a primary method of verifying your identity through OTP (One-Time Password) verification.
  • Security: It helps us prevent fraudulent accounts and protect against unauthorized access to your account.
  • Account Recovery: If you forget your password or lose access to your account, your verified mobile number allows us to securely restore your access.
  • Community Verification: As a community-based platform, phone verification helps ensure that users are real individuals from the intended communities.
  • Important Notifications: We may send critical security alerts, account notifications, and important updates via SMS.
  • Legal Compliance: Collection of verified mobile numbers helps us comply with Indian regulations, including the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

4.3 Why We Collect Your Email Address

We collect your email address for the following specific purposes:

  • Communications: To send you important information about your account, privacy updates, terms changes, and platform notifications.
  • Account Recovery: As a secondary method to help you recover your account if you lose access.
  • Customer Support: To communicate with you regarding support requests, inquiries, or issues with your account.
  • Updates and Newsletters: To share platform updates, community news, and other information you may opt to receive.
  • Legal Notices: To deliver legally required notices and communications.

You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding the password that you use to access the Service and for any activities that occur under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

We reserve the right to disable any user account at any time in our sole discretion, including if we believe that you have failed to comply with any provision of these Terms.

You are required to provide a valid mobile number and will be required to verify this number through an OTP (One-Time Password) verification process. This information is used to secure your account, recover your account, send you important notifications, and verify your identity.

5. Community-Based Platform and Administrative Approval

MyBader is a community-based platform designed to connect members of specific communities. The following provisions apply to our community structure:

  • Registration: Users of any age may register on the platform, including children as young as 1 year old (with parental consent for minors).
  • Administrative Approval: Full access to all features of the Service requires administrative approval.
  • Community Verification: We may require verification of your community membership.
  • Feature Restrictions: Prior to administrative approval, your access to certain features may be limited.
  • Parental Supervision: For users under 18, we strongly recommend parental supervision.

We reserve the right to deny or revoke administrative approval at our discretion if we determine that a user does not meet our community guidelines or for any other reason permitted by law.

6. Temple & Committee Membership

MyBader is organized around temple communities. The following rules apply to temple membership:

  • Single Temple Membership: Users can join only one temple at a time.
  • Administrative Control: Temple admins manage memberships and assign committee roles.
  • Compliance Requirement: Members must comply with temple values and community guidelines.
  • Membership Approval: Joining a temple requires approval from temple administrators.

7. Blocking & Reporting

To maintain a safe and respectful environment, users can:

  • Block other users to prevent them from contacting you or viewing your content
  • Report users for spam, harassment, hate speech, or threats
  • Report inappropriate content that violates our guidelines

All reports are reviewed by our moderators, and repeated violations may lead to account restrictions or bans.

8. User Content and License Grant

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material. You retain ownership of all Intellectual Property Rights in your User Content.

By posting, uploading, or sharing User Content on or through the Service, you grant MAIG Private Limited a worldwide, non-exclusive, royalty-free, fully paid, sublicensable and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such User Content in connection with providing and promoting the Service.

You represent and warrant that: (i) you own the User Content posted by you on or through the Service or otherwise have the right to grant the rights and licenses set forth in these Terms; (ii) the posting and use of your User Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights, intellectual property rights, or any other rights of any person; and (iii) the posting of your User Content on the Service does not result in a breach of contract between you and a third party.

You agree that you will not post User Content that is defamatory, obscene, pornographic, invasive of another's privacy, or that would otherwise violate the laws of India, including but not limited to the Information Technology Act, 2000, the Indian Penal Code, 1860, and the Indecent Representation of Women (Prohibition) Act, 1986.

9. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Using the Service for any purpose that is illegal or prohibited by these Terms.
  • Creating accounts through unauthorized means, including by using an automated device, script, bot, spider, crawler, or scraper.
  • Attempting to restrict another User from using or enjoying the Service or encouraging or facilitating violations of these Terms.
  • Impersonating another person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
  • Posting private or confidential information without permission, including but not limited to, credit card information, Aadhaar numbers, PAN details, or non-public phone numbers.
  • Soliciting, collecting, or harvesting user IDs, passwords, email addresses, or other personal information from other Users.
  • Interfering with, disrupting, or creating an undue burden on the Service or the networks or services connected to the Service.
  • Attempting to circumvent any content-filtering techniques we employ, or attempting to access areas or features of the Service that you are not authorized to access.
  • Uploading or transmitting viruses, malware, or other types of malicious code that will or may be used in any way that will affect the functionality or operation of the Service.
  • Engaging in any form of automated data collection or extraction, including scraping, data mining, or data extraction from the Service.
  • Posting content that promotes violence, discrimination, bigotry, racism, hatred, or harm against any individual or group.
  • Posting content that is harmful to minors in any way.
  • Posting content that violates or infringes someone else's rights, including intellectual property rights.
  • Posting content that promotes illegal or harmful activities or substances.

10. Content Removal and Account Termination

We reserve the right, but are not obligated, to:

  • Remove or refuse to distribute any User Content on the Service, including content that violates these Terms or our Community Guidelines.
  • Remove or block any User Content from the Service for any reason, without prior notice.
  • Terminate or suspend your access to all or part of the Service for any reason, including without limitation, if we believe that you have violated or acted inconsistently with the letter or spirit of these Terms.

If your account has been terminated for violation of these Terms, you may not create a new account on MyBader without our express permission.

In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, we will remove content within 36 hours upon receiving a court order or notification from an appropriate government agency about unlawful content.

11. Platform Moderation

To ensure a safe and respectful environment for all users, we utilize both manual and automated moderation tools:

  • Content Monitoring: We actively monitor user-generated content for compliance with our guidelines.
  • Automated Filters: We employ automated systems to detect and flag potentially harmful content.
  • Human Review: Our moderation team reviews flagged content and user reports.
  • Community Reporting: We rely on community members to report content that violates our guidelines.

Our moderation efforts are designed to maintain community standards while respecting user privacy and freedom of expression within the bounds of applicable laws.

12. Intellectual Property Rights

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of MAIG Private Limited and its licensors. The Service is protected by copyright, trademark, and other laws of both India and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of MAIG Private Limited.

If you believe that your work has been copied in a way that constitutes copyright infringement, please provide us with the following information as per the Copyright Act, 1957:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed.
  • Your contact information, including your address, telephone number, and an email address.
  • A statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

13. Data Localization and Transfer

In accordance with Indian regulations, certain categories of personal data, including financial data and critical personal data, may be stored exclusively on servers located within India. Other personal data may be transferred internationally in compliance with applicable laws.

Our servers are hosted on Amazon Web Services (AWS) infrastructure. By using our Service, you consent to the transfer of information to and from India and other countries as necessary to provide the Service to you and as permitted by applicable law.

14. Limitation of Liability

To the maximum extent permitted by law, in no event shall MAIG Private Limited, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service.
  • Any conduct or content of any third party on the Service.
  • Any content obtained from the Service.
  • Unauthorized access, use, or alteration of your transmissions or content.

Our liability shall be limited to the maximum extent permitted by Indian law. Nothing in these Terms shall limit or exclude our liability for gross negligence, willful misconduct, or any other liability that cannot be excluded or limited by Indian law.

15. Indemnification

You agree to defend, indemnify, and hold harmless MAIG Private Limited, its parent company, officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with:

  • Your access to or use of the Service.
  • Your violation of these Terms.
  • Your violation of any third-party right, including without limitation any Intellectual Property Right, publicity, confidentiality, property, or privacy right.
  • Any claim that your User Content caused damage to a third party.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Bangalore, India. The language of the arbitration shall be English. The number of arbitrators shall be one.

Notwithstanding the foregoing, you agree that MAIG Private Limited shall be entitled to apply for injunctive remedies (or an equivalent type of urgent legal relief) in any jurisdiction.

17. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

19. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

20. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of MAIG Private Limited.

21. Entire Agreement

These Terms, together with the Privacy Policy and Community Guidelines, constitute the entire agreement between you and MAIG Private Limited regarding your use of the Service and supersede all prior and contemporaneous written or oral agreements between you and MAIG Private Limited.
